Description

Authorize the Bureau of Right of Way to transfer to the Department of Environmental Services, sole management responsibility for a 6.56+/- acre portion of the Interstate Limited Access Right-of-Way located on the Southerly side of Interstate 89 along Silk Farm Road in the City of Concord. (2)Further authorize to adjust the limits of the Interstate 89 Limited Access Right-of-Way to accommodate the proposed transfer of management responsibility for the above-mentioned parcel to DES. Effective upon G&C approval. Because it has been determined by the DOT Division of Finance that this parcel was originally purchased with 90% Federal and 10% Highway Funds, and because DES proposes to develop the parcel for a government use not directly related to highways or their safety, DES intends to reimburse proportionately the corresponding funds in the aggregate amount of $130,000 by analogy to the reimbursement required by RSA 4:39-c upon the disposal of surplus real property acquired with highway funds, and further to transfer to DOT an administrative fee in the amount of $1,100.
